1. Acceptance of Terms

By accessing or using FindARisk ("the Platform", "we", "us") at findarisk.com, creating an account, or purchasing any product, you ("User", "you") agree to be legally bound by these Terms of Use ("Terms").

If you do not agree to these Terms in their entirety, you must immediately cease using the Platform. These Terms constitute a binding legal agreement between you and FindARisk.

You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are accessing the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. What FindARisk Is

FindARisk provides digital Pre-Delivery Inspection (PDI) checklists designed to assist car buyers in conducting their own visual and functional inspection of vehicles before accepting delivery or making a purchase.

Our checklists are:

• Informational guides based on general best practices for vehicle inspection
• Designed for use by non-expert users to conduct self-inspections
• Intended to supplement — not replace — professional mechanical inspections
• Not a guarantee of vehicle condition, safety, or suitability for purchase

3. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, THE PLATFORM AND ALL ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the platform will be uninterrupted, error-free, or secure
• Warranties that the checklist will identify all defects in any vehicle
• Warranties regarding the accuracy, completeness, or reliability of any content

FindARisk does not warrant that:

• Following our checklist will prevent you from purchasing a defective vehicle
• A vehicle that passes all checklist items is free from hidden defects
• Our scoring system accurately reflects the true condition or market value of any vehicle
• The platform will meet your specific requirements or expectations

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINDARISK AND ITS OWNERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

• Direct, indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Costs incurred in connection with a vehicle purchase or repair
• Losses arising from your reliance on our checklist or scoring system
• Losses arising from defects in a vehicle that were not identified during your inspection
• Losses arising from disputes between you and a vehicle dealer or seller

In all cases, FindARisk's maximum aggregate liability to you shall not exceed the amount you paid for the product that gave rise to the claim, regardless of the cause of action or the theory of liability.

You acknowledge that you are solely responsible for your vehicle purchase decisions. FindARisk provides a tool to assist your own due diligence — the final decision to purchase or reject a vehicle rests entirely with you.

5. User Accounts

To purchase and access our products, you must create an account using Google OAuth authentication. You agree to:

• Provide accurate and current information
• Maintain the security of your Google account credentials
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

You may not create accounts using false identities or for the purpose of circumventing restrictions. We reserve the right to terminate accounts that violate these Terms without prior notice.

One account per person. Accounts are non-transferable.

6. Purchases & Access

All purchases on FindARisk are for digital products delivered electronically and immediately upon payment. By completing a purchase, you acknowledge that:

• Digital delivery begins immediately upon payment confirmation
• Access is linked to your registered account and is non-transferable
• You may access your purchased checklist from any device using your account
• Purchases are subject to our Refund Policy

All prices are in Indian Rupees (INR) and inclusive of applicable taxes. We reserve the right to change prices at any time. Price changes will not affect purchases already completed.

We use Razorpay as our payment processor. By making a payment, you also agree to Razorpay's Terms of Service available at razorpay.com/terms.

7. Intellectual Property

All content on FindARisk — including but not limited to checklist content, inspection tips, scoring methodology, website design, code, text, graphics, and branding — is the exclusive property of FindARisk and is protected by Indian and international copyright law.

Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the purchased checklist for your personal, non-commercial use only.

You may NOT:

• Copy, reproduce, or redistribute any checklist content in any form
• Share your account credentials with others to give them access
• Sell, sublicense, or commercially exploit any part of our content
• Screengrab or photograph the checklist to share with non-purchasers
• Create derivative works based on our content without written permission
• Use our content to build a competing product or service

Unauthorised use of our intellectual property may result in account termination and legal action under the Copyright Act, 1957 and Information Technology Act, 2000.

8. Prohibited Uses

You agree not to use FindARisk to:

• Violate any applicable Indian or international law or regulation
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorised access to any part of the platform or its infrastructure
• Interfere with or disrupt the integrity or performance of the platform
• Use automated scripts, bots, or scrapers to extract content
• Conduct any fraudulent activity including payment fraud or chargebacks without legitimate basis
• Reverse-engineer, decompile, or disassemble any part of the platform
• Use the platform for any purpose that is harmful, offensive, or illegal

9. Termination

We reserve the right to suspend or terminate your account and access to all purchased products at our sole discretion, without prior notice, if we believe you have:

• Violated any provision of these Terms
• Engaged in fraudulent activity (including chargeback fraud)
• Shared or redistributed our proprietary content
• Provided false information during account creation

You may terminate your account at any time by contacting us at support@findarisk.com. Termination does not entitle you to a refund unless permitted under our Refund Policy.

Upon termination, all licences granted to you under these Terms immediately cease. Provisions that by their nature should survive termination (including Sections 3, 4, 7, and 10) shall survive.

10. Dispute Resolution

In the event of any dispute, controversy, or claim arising from or relating to these Terms or your use of FindARisk, the parties agree to the following resolution process:

Step 1 — Informal Resolution

Contact us at support@findarisk.com with a description of your dispute. We will make a good-faith effort to resolve the matter within 15 business days.

Step 2 — Mediation

If informal resolution fails, either party may request mediation before a mutually agreed mediator in Pune, Maharashtra, India.

Step 3 — Arbitration

If mediation fails, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India, with a sole arbitrator appointed by mutual agreement. The arbitration shall be conducted in English in Pune, Maharashtra.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Subject to the dispute resolution process above, you agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Pune, Maharashtra, India, and you consent to the personal jurisdiction of such courts.

The Consumer Protection Act, 2019 and other applicable Indian consumer protection laws apply to the extent required by law and are not excluded by these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send an email notification to registered users at least 14 days before the changes take effect
• Display a prominent notice on our website

Your continued use of FindARisk after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the platform.
